The article analyzes economic factors of competition development in Russian gas industry. The analysis is conducted on the basis of comparison of structural characteristics of competition with peculiarities of industrial markets in different stages of production process in the gas industry. The conclusion about the necessity to keep vertical integration with competition in the industry is maintained with the analysis of alternative opportunities of provision of the open access to pipelines for independent extracting companies.

The article aims to define the main peculiarities of competition analysis in case of innovation markets. Using the example of Apples iTunes Store antitrust suit, the main characteristics of the development of knowledge-based industries are applied to the analysis.

В статье раскрыты основные векторы юридической политики российского самодержавия, присущие государственно-правовым инициативам молодого Петра I на рубеже 1690-х - 1700-х гг. Выявлены общие направления законодательных стратегий, нацеленных на конструирование политико- юридической модели "надсословной монархии". Данная модель рассматривается как средство легитимации самодержавного политического режима в условиях реализации неравенства прав состояния и опосредованного различиями сословных статусов отношений подданства. Автор подчеркивает мифологическую природу надсословного принципа организации верховной власти в условиях отсутствия ее стабильной вертикали и соответствующего юридического сопровождения. Особое внимание уделяется исследованию репрезентативной роли законодательства, обеспечивающего восприятие политического имиджа правящего лица как единственного гаранта "общего блага" при помощи мифологизации его статуса в политической системе российского самодержавия. ; The article reveals the main vectors of the legal policy of the Russian autocracy inherent in the state-legal initiatives of the young Peter I at the turn of the 1690s - 1700s. The general directions of legislative strategies aimed at constructing a political and legal model of a "supranational monarchy" are revealed. This model is considered as a means of legitimizing an autocratic political regime in the conditions of realization of inequality of rights of the state and mediated by differences in class statuses of citizenship relations. The author emphasizes the mythological nature of the supra-verbal principle of the organization of supreme power in the absence of its stable vertical and appropriate legal support. Particular attention is paid to the study of the representative role of legislation that ensures the perception of the political image of the ruling person as the sole guarantor of the "common good" by mythologizing his status in the political system of the Russian autocracy.

В статье выявлены основные направления правовой политики российского самодержавия по отношению к национальным регионам и институтам местного законодательства, выявлен ее интеграционный потенциал, показано соотношение между общеимперским правом и юридическим партикуляризмом, в том числе и в сфере сословного законодательства. Законотворческая тенденция к сохранению национально-политической идентичности ряда партикулярных институтов права рассматривается как часть надсословной стратегии Российского государства нового времени, направленной на укрепление социально-политического имиджа верховной императорской власти. ; The article reveals the main directions of legal policy of the Russian autocracy in relation to the national regions and institutions of local legislation, revealed its integration potential, shows the relationship between the General law and legal particularism, including in the area of estates law. The legislative trend towards preservation of national-political identity of a number of particular institutions of law considered as part of supra-estate strategy of the Russian state the new time aimed at strengthening the socio-political image of the Supreme Imperial power.

В статье рассматривается возможность использования методологических конструкций, созданных в рамках научного направления "история и политика памяти", применительно к историко-правовым исследованиям. На основе сопоставления церемониальных текстов и законодательного сопровождения официальных мероприятий московского двора, автор делает вывод о превращении самопрезентаций верховной власти в важный инструмент юридической политики Российского государства XVII столетия. ; The article discusses the use of methodological designs, created in the framework of the research area "the history and politics of memory", in relation to historical and legal research. On the basis of a comparison of ceremonial texts and legislative support of the official events of the Moscow courtyard, the author concludes about the transformation of the self-presentations of the Supreme power in the important legal instrument of the Russian state policy in the XVII century.

The article is devoted to revealing the super-legal nature of the ceremonial text of the coronation of Paul I, which is regarded as part of the political and legal strategy of the Russian autocracy aimed at legitimizing the absolute prerogative of the monarch to determine the ways of social and political influence of power struc-tures on citizenship and social stratification. On the basis of the politico-legal approach to interpreting a number of legal information carriers at the end of the 18th century, the author comes to the conclusion that the nobiliary representational codes of the coronation ceremonial have played a key role in the institutionalization of the superseworthy image of the imperial power in the subsequent period. ; Статья посвящена выявлению надсословной природы церемониального текста коронации Павла I, которая рассматривается как часть политико-юридической стратегии российского самодержавия, направленной на легитимацию абсолютной прерогативы монарха определять способы социально-политического воздействия властных структур на отношения подданства и социальную стратификацию. На основе политико-юридического подхода к интерпретации ряда носителей правовой информации конца XVIII в. автор приходит к выводу о продворянской направленности репрезентативных кодов коронационного церемониала, сыгравших ключевую роль в институционализации надсословного имиджа императорской власти последующего периода.

The article discusses the unexplored problem of political and legal specificity of the formation of the local legislation of Imperial Russia as part of the integration policy of supraestate political regime. The article is devoted to the identification of supranational political and legal strategies that were used by the Russian ruling elite during the institutionalization of the monarch's autocratic power and ensuring its dominant position in the political system of the Russian Empire. With political and legal point of view, class legisla-tion was seen as the main tool of the media exposure of the autocracy in all social strata with the purpose of concentration of socio-political resources to achieve na-tional interests. The ineffectiveness of legal means, which make it possible to main-tain the image of the Supreme power in a paternalistic way, predetermined the special attention of official circles to the visual-mnemonic means and representative possibilities of memory policy. ; Статья посвящена выявлению надсословных политико-юридических стратегий, которые применялись российской правящей элитой в ходе институционализации самодержавной власти монарха и обеспечения его доминирующего положения в политической системе Российской империи. С политико-юридической точки зрения сословное законодательство рассматривалось как основной инструмент воздействия носителей самодержавия на все социальные слои общества с целью концентрации социально-политических ресурсов для достижения общегосударственных интересов. Неэффективность правовых средств, дающих возможность поддержать имидж верховной власти в патерналистском ключе, предопределила особое внимание официальных кругов к визуально-мнемоническим средствам и репрезентативным возможностям политики памяти.

The article discusses the correlation of explanatory and interpretative models of scientific knowledge in historical and legal science, traditionally aimed at identi-fying the historical continuity of legal structures and legal systems in accordance with the formal-logical approach to the assessment of sources of law. Using the example of a supra-class problem related to the clarification of the political and legal context of the institutionalization of the class institutions of the Russian autocracy, it is concluded that the anthropological approach is consistent with the sociocultural nature of the history of the state and law. ; В статье рассматривается соотношение объяснительной и интерпретационной моделей научного знания в историко-правовой науке, традиционно нацеленной на выявление исторической преемственности юридических конструкций и правовых систем в соответствии с формально-логическим подходом к оценке источников права. На примере надсословной проблематики, связанной с уяснением политико-юридического контекста институционализации сословных институтов российского самодержавия сделан вывод о соответствии антропологического подхода социокультурной природе истории государства и права.
